Elizabeth Martinez is suing her former funeral home employer for making her sick by disposing of his soiled adult nappies in the office waste paper basket.

Martinez had to see a doctor when she was struck down with stomach pains. Her physician diagnosed a bleeding peptic ulcer which was caused by the H. Pylori virus. Her doctor told her that the virus can only be caught from human faeces.

Martinez told the court that her former employer at the Ruffner-Wakelin Funeral Home in Arizona had spread his fecal matter around the office by disposing of his dirty nappies in the waste paper bin and not washing his hands afterwards.

CEO of the company Fred D. Wakelin is alleged to have defecated himself frequently whilst sat at his desk and would then dispose of his bodily waste in the waste paper basket nearby. In her claim Martinez states that Wakelin failed to properly clean or sanitize his person or the items he touched which were in use in the office, some of which he knew would be handled by her.
